Do You Need a Lawyer for an Uncontested Divorce?

    SamanthaBy SamanthaFebruary 18, 2023No Comments3 Mins Read

Are you planning to divorce your spouse without fighting in court? If so, you probably have a lot of questions in mind regarding what’s involved in an uncontested divorce and what you must do. One of your concerns may be whether or not you need a Turco Legal, P.C. divorce attorney if you and your spouse agree on everything.

    What is Uncontested Divorce?

In this kind of divorce, you and your spouse agree on the terms and conditions of your divorce without taking the case to court. This includes child custody, property distribution, and spousal support. If you don’t agree on even one issue, you will have a contested divorce for which you need a lawyer.

How to Prepare for an Uncontested Divorce

For your divorce to be considered uncontested, you must agree on every aspect of the separation, complete and file divorce paperwork with a divorce court, submit a settlement agreement you and your spouse signed, and appear in a final court hearing.

An uncontested divorce is straightforward. But if you are thinking about an uncontested divorce, you must consult with an attorney before you proceed. The reason is that divorce involves a lot of legal issues and you want to ensure you know your obligations and rights.

Should You Hire an Attorney for an Uncontested Divorce?

The answer is a big yes. A divorce attorney can help protect your interests and rights as well as guide you as you proceed with the divorce. Also, they can make sure important paperwork is filed with the court. They can give you court representation, if needed.

Have You Truly Agreed on Everything?

Some couples opt for an uncontested divorce end up leaving something out of their divorce agreement. This can occur as it’s hard to predict all possible things that could take place during and following a divorce. For instance, a couple may agree to share child custody; however, they may fail to address what to expect if one spouse decides to live in another state. In this case, you may need an attorney to help you resolve this problem.

Likewise, you may agree on the way your assets are divided, but not address what happens if you or your spouse passes away before your divorce is finalized.  In this case, an attorney can negotiate an agreement with your spouse to address this problem.

Given these possibilities, you should consider hiring a divorce attorney even if you think you and your spouse have agreed on everything. Your attorney will review your agreement, ensuring it’s legally binding.
